Purchasing tickets online

Preamble

These conditions of sale apply automatically and without restriction to all orders made for the purchase of show ticket(s) on the computerized ticketing website of SES des Frères Bouglione, 110 rue Amelot 75011 PARIS.

They are subject to change without notice. The purchase of show ticket(s) by the buyer implies his unreserved acceptance of these conditions of sale.

Anyone making a purchase of either a ticket or a product on the Cirquedhiver.com website is invited to carefully read the T&Cs, which aim to define the contractual relationship between them and Cirquedhiver.com, as well as the conditions applicable when purchasing tickets online.

The language of these T&Cs is French. In case of translation of all or part of these conditions, only the original French text is authentic.

The confirmation of the order via this website leads to the conclusion of the definitive contract. This implies the unreserved acceptance by the customer of all of the GCS, which he acknowledges having read beforehand at the validation of his purchase. The customer accepts the provisions concerning security and the additional regulations relating to access to the room or to any other place of performance.

The customer is aware of the fact that in the event that these regulations are not respected, he will be refused access to the room without compensation.

The applicable GCS are those in force on the online sales site on the date of purchase of the ticket. Cirquedhiver.com reserves the right to adapt or modify these T&Cs at any time and without notice, to the fullest extent permitted by law.

This Cirquedhiver.com online ticketing service allows you to buy tickets for shows.

Article 1 - Rates

The price of seats is inclusive of VAT including rental costs*.

The applicable prices are the prices indicated in the programs and displayed at the Cirque d’Hiver Bouglione ticket offices.

All rates are subject to change without notice. However, the tickets will be invoiced on the basis of the rates in force at the time of your order validation.

They are validated only after confirmation from us of the requested payment.

The tickets are nominative and cannot be resold at a higher price (law of June 27, 1919).

The number of seats per transaction cannot exceed 8.

1.1-Reduced rates

For reduced rates, the presentation of recent proof is mandatory. No reduction is applicable after payment of the order.

Article 2 - Location of seats

Depending on the configurations, you may be offered the following seats:

2.1- Numbered seats

For performances for which there is a numbered seat, your seat number will be indicated to you when ordering.

For performances for which the seating is numbered, the customer will be assigned an automatic seating offered by the online sales site. No subsequent complaint can be taken into account.

2.2- Free places

For performances for which seating is not numbered, spectators are free to choose their location in the room.

Article 3 - Secure payment and personal data

3.1 Method of payment / secure payment

Ordering tickets only commits SES des Frères Bouglione upon receipt of an e-mail confirming payment for the transaction.

Payment is exclusively accepted online.

Tickets purchased on the Cirquedhiver.com website are paid for only by credit card from the VISA network and cards compatible with the BNP PARISBAS ATHOS secure payment site. (Credit card / Visa / Eurocard / Mastercard).

The information provided by the customer when entering his bank details is encrypted by our bank to protect all sensitive data as effectively as possible during payment. The online payment transaction is handled by the BNP PARISBAS ATHOS system. This transaction is carried out using a secure and SSL encrypted system. Under no circumstances and at no time does credit card information pass through the Cirquedhiver.com server.

Once Cirquedhiver.com confirms that the order has been validated, your card will be debited.

In the event of a problem with the payment: check the validity as well as the authorized limit of your card.

Some banks require an additional code for online purchases, please contact your bank for more information.

3.2 Personal data

The information and data concerning you are necessary for the management of your order and for our commercial relations. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations and to allow us to improve and personalize the services we offer and the information we send you.

Article 6 - Method of obtaining tickets

The ticket(s) and the confirmation of the online purchase must be checked by the purchaser when they are received. No subsequent complaint can be taken into account.

Tickets issued are unique.

However, duplicates may be printed in the event of theft or loss observed on presentation of an identity document, the confirmation email received when purchasing tickets online, or if it is possible to find a trace of the reservation on the ticketing software. In any case, even in this case, only the ticket holder is entitled to occupy the seat.

In general, the methods of obtaining the tickets offered to you online are linked to the time between the date of the reservation and the date of the event as well as the nature of the rate chosen and the conditions for benefiting from it. The methods of obtaining are as follows:

6.1. Print at Home Ticket

Specific conditions for the Print at Home Ticket:

The print-at-home ticket allows you to print purchased tickets on an ordinary printer from internet access.

To be valid, your ticket must be printed in portrait mode, on a white A4 sheet, blank front and back.

Each seat purchased corresponds to a ticket.

Print-at-home tickets have a unique barcode. The validity of the tickets is checked and recorded at the entrance to the theater concerned using bar code readers. It is not possible to be admitted to the entrance several times with the same ticket. Reproduction of tickets is prohibited. Only the first person to present the ticket will be allowed to attend the event. She is presumed to be the legitimate bearer of the note. It is therefore prohibited to reproduce, duplicate or counterfeit the ticket in any way, or to make it available for such purposes. Keep your ticket in a safe place. Never accept a ticket offered to you by a stranger, as it could be a copy.

The organizer may refuse entry to the event when several prints, reproductions, copies or imitations of a print-at-home ticket are in circulation and access to the event has already been previously granted to the holder of a printout, reproduction, copy or imitation of the corresponding print-at-home ticket. In particular, the organizer is not obliged to verify the identity of the person presenting the print-at-home ticket in order to verify that it is indeed the ticket buyer, nor to verify the authenticity of the print-at-home ticket insofar as the imitation or copy cannot be identified beyond doubt as such during the entry control to the event. If the holder of a print-at-home ticket is turned away for this reason during an access control, there is no right to reimbursement of the price paid.

SES Des Frères Bouglione declines all responsibility: for anomalies that may occur during the ordering, processing or printing of the print-at-home ticket insofar as it has not caused them intentionally or as a result of negligence in the event of loss, theft or illicit use of the print-at-home ticket.

6.2. Withdrawal at counters

Tickets purchased online can be collected at the counter.

Obtaining tickets at reduced rates can only be done by means of a withdrawal at the counter on presentation of proof. The method of withdrawal will therefore be indicated to you when you buy tickets online.

Places are given on presentation of the confirmation email.

In the absence of proof of reduced rates or presentation of the nominative membership card, the normal rate will be applied. An additional fee will therefore be requested. Resale at a rate higher than that indicated on the ticket is prohibited (law of June 27, 1919).

6.3 Sending tickets by post

Tickets can only be sent by post if the time between payment of the order and the date of the first show is more than one working week.

Tickets are sent by single fold and SES des Frères Bouglione declines all responsibility in the event of loss or theft by La Poste.

The shipment is charged 1.06 Euro per order.

If tickets are purchased more than 60 days before the show date, tickets will only be sent within 10 days of the show date.

Article 7 - Schedules and venue

The date, place and time of the show are indicated on the ticket.

The shows start on time, the doors of the room generally open between 15 and 30 minutes before the show.

Latecomers can only be seated during an interruption of the show or depending on accessibility in the hall. To access the room, latecomers must follow the instructions of the hosts and hostesses, and numbered seats are no longer guaranteed.

Please note that due to artistic constraints inherent in certain shows, it may be impossible to admit latecomers.

The duration of the show for the creations is variable and known only a few days before the show.

Article 8 - Cancellation

No cancellation is possible after the payment of the tickets by the customer. In terms of shows, case law considers that the relationship that is established between the performance hall which announces a show, indicates the price of seats and the time of performance and the public who buys a ticket, regardless of the method of payment (cash, check, credit card, money order), is a contractual relationship. Under these conditions, it is only if the entertainment company does not fulfill its obligation that the spectator can request reimbursement or contest the contract with the performance hall.

SES des Frères Bouglione reserves the right to make any changes in the order, duration and distribution of the show. On the other hand, SES of the Bouglione Brothers reserves the right to cancel any performance that cannot take place if fortuitous events or cases of force majeure force them to do so, such as (and without this list being exhaustive) bad weather, strikes, fire, water damage, illness of a performer, etc. In such a case, SES des Frères Bouglione would propose another performance date or, failing that, the reimbursement of the ticket.

If a performance is interrupted after the first half of a show, tickets cannot be taken back, exchanged for another date, or refunded.

Article 9 - Right of withdrawal

In accordance with Article L 121-20-4 of the Consumer Code, tickets for shows and inseparable products cannot give rise to withdrawal by the customer.

Article 11 - Applicable law - Disputes

Any dispute concerning the online purchase process, whatever its nature, must be made in writing no later than the evening of the performance to the following address:

All other disputes must be made on the evening of the performance directly with the venue offering the show.

SES des Frères Bouglione 110 rue Amelot 75011 PARIS declines all responsibility for damage, whatever its nature, which may affect the effects, objects or materials brought by the spectators. Spectators are responsible for any direct or indirect damage that they may cause during their presence at the venues.

The tickets do not give any right to a recording of the show. Any recording, in any form whatsoever, including photographically is strictly prohibited. SES des Frères Bouglione 110 rue Amelot 75011 PARIS reserves the right to initiate proceedings for compensation for damages suffered.
